Sharma, wife granted $3M judgment against NTN

JUSTICE Jainarayan Singh yesterday granted judgment in the sum of more than $3M to C.N. Sharma and Savitree Singh-Sharma against Chandra Prasad Narine & Anand Persaud, trading under the name and style of National Television Network (NTN 69) for libel.

The libel was said to be published on the 6, 7 & 8th October, 1997.

The plaintiffs were Mr. C. N. Sharma and wife Savitri Sharma. The defendants were Anand Persaud, J. Narine and Chandra Prasad Narine, trading under the name of the National Television Network.

In his judgment, Judge Jainarayan Singh said that the words complained of were uttered by Parliamentarian Clinton Collymore, who, at a public meeting at Grove, E. B.D. said "Sharma left his decent and beautiful wife to take a hot crutch little girl."

The judge added, "It would appear that Mr. Clinton Collymore apologized to Sharma and his wife for his statement, as a result he was not made a party in the action.

"There was no evidence before this court that J. Narine and Anand Persaud were the owners or executives of the National Television Network or that they caused the said words to be published on the NTN Network. I therefore have no alternative than to dismiss the action against those named defendants.

"It is beyond dispute that the offending statement referred to C. N. Sharma, as he was called by name, also no legal sophistry or a strained and unnatural words as projected by Mr. Nandlall for NTN can convince this court that the words ‘hot crutch little girl’ did not refer to Savitri Sharma the second named plaintiff in the suit. She gave evidence that as a result of these words she suffered grave embarrassment, caustic remarks by way of telephone calls from members of the public, and sympathy from her friends and well-wishers.

"The fact that she is and was at the same time a prominent member of a popular Hindu organisation amplified her embarrassment. And it is interesting to note that in his cross-examination of Mr. Sharma, Mr. Nandlall recognised Mrs Sharma as a prominent member of the said religious organisation.

"However, I am not convinced even of the balance of probabilities that Mr. C.N. Sharma swore that he lost the opportunity to become the President of Guyana as a result of the offending statement.

"It is clear that the statement was meant to indicate in the eyes of right thinking members of the public that Mr. Sharma was a man of loose morals, but I accepted his evidence that he was already separated from his first wife when his relationship with his present wife commenced.

"However, I feel only normal damages could be awarded in respect to C.N. Sharma. It is therefore the order of this court that Chandra Prasad Narine, the Registered owner for NTN, be condemned in damages in favour of Mr. C. N. Sharma in the sum of $500,000 and secondly in favour of Saviti Sharma, damages in the sum of $2.5M.

Costs were awarded in the sum of $100, 000.
Mr. Nigel Hughes appeared for the plaintiffs.
Mr. Nandlall's application for a stay of execution for six weeks was refused.

Is this the guy Jagdeo wants to make Attorney General?

Jagdeo would be better off making nice with Justice Claudette Singh and make her Attorney General instead. The woman suffered enough because of the bad-minded PPP. And Anil cannot walk a yard in her shoes.

Following this fiasco Mr. Collymore was forced to apologise/resign .............???????? Or not????
